December is for Deciding to File Bankruptcy in NJ

Huh? What? Did I read that headline right? December is for Christmas, Hanukkah, Kwanzaa, and celebration! It is a joyous time of year when people are nice to each other, if only for a few weeks before it's back to reality. How can it be for bankruptcy?

Two Reasons to File Now

Well, in my opinion, it is so for two reasons. First, in addition to Christmas and the other holidays mentioned, there is New Year's! A new year, a new beginning. Bankruptcy, by its very nature, is all about new beginnings and fresh starts. It is about hitting the financial reset button, clearing the decks, and starting anew.

It is about giving yourself permission to accept their economic situation, and that it is all right to file bankruptcy. For them, it is a way of keeping the specter of indebtedness from following them into yet another year.

Second, the holidays often bring to the fore the harsh reality that you are in too deep and need to file bankruptcy. The cards are maxed out, even the minimum payments are unaffordable, and holiday gifts are just about beyond reach. How can you keep this up?

No, I am not trying to depress you at what should be a happy season. I am not trying to drum up more business (and yes, more fees) before the end of the year.

I am trying to get you to realize that you need to give yourself the best present of all: one that gives you peace of mind, a good night's sleep, and hope for a brighter future. If payment of your debts is beyond reach, it is never going to get better. Putting it off until after December can only make things worse.
