Can I remove (expunge) my arrest in NJ from my record if I was not convicted?

A:

Sometimes people can be haunted by a criminal charge in their past, even though they were never convicted.  The good news is that they can be erased or "expunged."  Under New Jersey law, any person arrested for a crime (felony), disorderly or petty disorderly persons offense (misdemeanor), or municipal ordinance violation, where it was discharged without conviction may apply for an expungement at any time after the disposition of the criminal proceedings.

The situation is a little different with a Conditional Discharge, where the charges were dismissed after the successful completion of a supervisory treatment program.  In this case, you have to wait at least six months following the dismissal of the charges.
