Speeding Ticket Dismissed Due to Paperwork
Although speeding tickets are very difficult to fight and win (even a speed of 1 mph over the limit results in conviction; radar results are routinely accepted by the courts), there are rare occasions when this is possible, which is why I always recommend that you have an attorney review your case before you just go in and plead guilty to the ticket.
I had a client that had just recently had his driver's license restored after it had been suspended for the accumulation of too many points. Not long after that, he had been stopped for speeding. Since his restoration was provisional, any moving violation (including New Jersey's "no point ticket") within a certain period of time would have resulted in his license being suspended, again, so his options were limited. He came to me to review his case.
On the day the ticket was issued, he had been driving on a local road when a patrol car passed him going the other direction. Soon afterwards, the patrol car turned around and followed him, pulling him over for speeding, having radar data to back it up. However, whenever a patrol car is moving with an active radar unit, not only must the radar be calibrated properly, but the speedometer on his vehicle must be as well. This is because the determination of someone's speed must take into account an accurate speed of the patrol car or everything gets thrown off.
When I carefully reviewed the certification for the speedometer, I found a discrepancy in the test that would prevent the radar reading from being considered by the judge. As a result, the charge was dismissed, and my client walked out of court with his driver's license.
